Louis Shepherd, in
addition to being a lifelong conductor on the CSX railroad, is one big Winston
Cup fan. That’s why after a successful settlement of his case, Mr. Shepherd of
Louisville, Kentucky, hand-painted a custom Hoey, Farina & Downes Winston
Cup race car as a gift to our firm.

We thought this gift was
special enough to share with other railroaders -- not only because we happen to
be big fans of stock car racing ourselves – but because Mr. Shepherd’s case
is a good example of how our law firm – acting like a NASCAR pit crew – can
ably assist in bringing about rock solid results.
Mr. Shepherd was injured on a defective hand brake. After a proper medical
evaluation, the injury was determined to be so severe to amount to a
career-ender. In the run up to the trial, we hired a liability expert to
establish what Mr. Shepherd already knew full well: the defective handbrake was
a clear violation of the Safety Appliance Act.
However, the
railroad pushed the case into overdrive when they refused to reach an
appropriate settlement offer – a move designed to test the resolve of Mr.
Shepherd as well as our firm.
But like a driver
slowly working his way from the back of the pack and taking the advice of his
pit crew at each juncture, Mr. Shepherd refused to settle for less than he
thought sufficient. We pushed forward through all the pre-trial motions and even
selected a jury when -- the day before opening statements -- the defendant
railroad finally reached the appropriate offer level.
The settlement was
first and foremost a victory for Mr. Shepherd, who said he received just
compensation for his career ending injury. But we also consider it a victory for
our firm, which by chalking up another win in the “Kentucky circuit”
rededicated our efforts to better serve Kentucky railroaders.
This is why we
appreciate Mr. Shepherd’s Hoey, Farina & Downes Winston Cup race car so
much. We think it shows how just like a well-honed pit crew is a critical part
of a successful NASCAR season, having the advice of the right legal counsel if
you get injured on the railroad is critical to a successful outcome of your
case.
Mr.
Shepherd’s case is only one of the more recent examples that demonstrate why
