Jury awarded Plaintiff $1,390,000.00 under FELA – cumulative trauma / excessive vibration.

A locomotive engineer for Defendant railroad was exposed to an unreasonable hazard of personal injury due to locomotive unit vibration. As a result, Plaintiff’s spine became severely degenerated and required rods and cages to stabilize it. The FELA case was filed in Louisville, Kentucky. Defendant railroad offered $15,000.00 to settle. Plaintiff and several coworkers testified the Defendant’s locomotives had a harder ride and more vibration than locomotives of other railroads. Plaintiff’s liability expert testified that the manner of construction and lack of maintenance resulted in the excess vibration.
